Sen. John Barrasso asked his Senate colleagues this week to block a proposed rule from the Environmental Protection Agency that would redefine several forms of surface water in the United States.
EPA documents say the rule is meant to solve legal confusion caused by Supreme Court decisions in 2001 and 2006 that left Clean Water Act jurisdiction unclear for small streams and wetlands.

The rule clarifies the EPA's intent to protect small streams, wetlands and other surface waters under the Clean Water Act. EPA statements released at the time of the rule's announcement say the move would not protect any new waters but would clarify waters already protected under current law. Barrasso is correct. The EPA is taking public comment on the agricultural exemptions included in the rule until July 7 and is taking general comment until Oct. 20. Comments can be submitted online via the federal rulemaking portal.
